Roque: Duterte ready to face charges in PH court

Former President Rodrigo Duterte who is facing accusations of crimes against humanity before the International Criminal Court will not allow a foreign prosecutor to exercise jurisdiction over him, one of his legal counsels said.

In an interview with ANC's Headstart on Tuesday, lawyer Harry Roque said he met with Duterte, former Executive Salvador Medialdea and Solicitor General Menardo Guevarra over the issue.

"He (Duterte) has made his position very clear: Now that he is no longer president, he no longer has immunity from suit. All those who have grievances or complaints against him should file a criminal case before a Philippine prosecutor. If there's probable cause, he's willing to face them but before a Philippine court," Roque said.

He added that if Duterte is found guilty of violating the Philippine International Humanitarian Law, he will be imprisoned in a Philippine jail.

"Under no circumstance will he allow a foreign prosecutor, any foreign judge, court to exercise jurisdiction over him," he asserted, adding that if the ICC will pursue, they will ask for restraining order in a local court.

"He will argue the Philippine courts are willing and able to prosecute these cases and therefore there's no basis for foreign institutions to interfere and these are the consequences of a foreign country," Roque added.

The Philippines withdrew from the Rome Statute in 2018, which took effect a year later.

President Ferdinand "Bongbong" Marcos Jr. said Monday that the Philippines has no intention of rejoining the ICC under his administration.
