The Terms and Conditions of Nutshell shall manage your use of the mobile application accessible through download on AppStore and Google Play Store. 
By using the Service, you agreed to accept all terms and conditions herein. Do not use Nutshell if you disagree with any of these terms and conditions.

• “Nutshell”, “We”, “Us”, “the Service”, “the App” refers to the mobile application downloadable from Google Play or the AppStore and the licensors or owners of the said app.
• “You”, “User” refers to the person who downloaded and has agreed to the usage of the Service.
• “Google Play”, “AppStore” refers to the where the Service can be downloaded.

 

User Rights and Responsibilities

• You are requested to provide us your information to facilitate the Service. The information gathered will be used to improve the performance of the app.
• You are required to download the app and the succeeding updates to further use the Service. In the same manner, your use of the app means you consent us to collect your information and you agree to the terms and conditions herein.
• You may personalize your account by choosing the topics or categories you like to appear first on your feed and may also read the full article by clicking on the third-party link that will direct you to the news source.
• Your use of app is free of cost. However, we cannot fully promise that it will still be free in the future. We will give our best to keep it free or we will notify and ask for your consent regarding this issue.
• Any violation or abuse to the user rights and responsibilities may be subjected to account suspension or termination.

 

Service Provisions

• Nutshell is a mobile app that provides summarized news from various sites to give fast and convenient in-app experience for users. The app may include third-party links such as the original news source but it is not liable for the content or accuracy of the news or information provided by the third-party.
• Nutshell is not a news publication. It does not write nor provide in-house content but summarizes news and information to provide the gist of the topic. It is also unbiased and the act of summarizing content is to shorten the original article for easy reading. Any opinion or statement within the article does not express the view of the Service.

 

Intellectual Property Rights

Other than the content you own, under these Terms, Nutshell and/or its licensors own all the intellectual property rights, technology, and materials (trademark, logo, brand, etc.) contained in this mobile application. You are granted a limited license only for the purpose of viewing the material contained on this Website.

The Service does not claim ownership to the news or information summarized from various news sites nor all the rights owned by third parties.

 

Restriction

The following are strictly restricted for all users or members:

• Using it in any way that is or may be damaging to the Service;
• Using it in any way that negatively impacts user access to the Service;
• Using the Service contrary to applicable laws and regulations, or in any way may cause harm;
• To the Service, or to any person or business entity;
• Engaging in any data mining, data harvesting, data extracting or any other similar activities;
• Using it to redistribute, sublicense, publish, sell, and other means to illegally market the Service;
• Using it to alter the Services or some of its parts that threatens its functionality and structural integrity;
• Using it to illegally extract and distribute information for unlawful purposes.

Any user ID and password you may have for this app are confidential and you must maintain confidentiality as well.

 

No warranties

This mobile application is provided "as is," with all faults, and it expresses no representations or warranties, of any kind related to or the materials contained on this application. There is no warranty that the Service will always function perfectly without details or errors. However, improvements will be done to ensure the quality, security, and performance of the Service.

You hereby indemnify to the fullest extent the Service from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your breach of any of the provisions of these Terms.

 

Severability

If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.

 

Assignment

The Service is the only one allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. You will be notified regarding any changes to the policies or these terms and thus, you are highly advised to read and consent to the updated terms as you use the Service.

 

Entire Agreement

These Terms constitute the entire agreement between the Service and you in relation to your use of this app and supersede all prior agreements and understandings.

 

Governing Law & Jurisdiction

These Terms will be governed by and interpreted in accordance with Philippine Laws, and you submit to the non-exclusive jurisdiction of the City of Taguig for the resolution of any disputes.
